LEAVE AND LICENSE AGREEMENT - SAMPLE FORMAT
This Leave and License Agreement is made on [Date] at Mumbai.
BETWEEN
[Licensor Full Name], aged about [Age] years, residing at [Address], hereinafter referred to as the "Licensor";
AND
[Licensee Full Name], aged about [Age] years, residing at [Current Address], hereinafter referred to as the "Licensee".
1. PREMISES
The Licensor grants to the Licensee a temporary leave and license to use the premises situated at [Full Property Address], together with fittings and fixtures described in Schedule A.
2. TERM
The license shall commence on [Start Date] and shall remain in force until [End Date], unless terminated earlier in accordance with this Agreement.
3. LICENSE FEE
The Licensee shall pay a monthly license fee of Rs. [Amount] on or before the [Day] of each month.
4. SECURITY DEPOSIT
The Licensee has paid an interest-free refundable security deposit of Rs. [Amount], receipt of which the Licensor acknowledges. The deposit shall be refunded at the time of peaceful handover, subject to adjustment for unpaid dues or damages beyond normal wear and tear.
5. USE OF PREMISES
The premises shall be used only for residential purposes by the Licensee and permitted family members. The Licensee shall not use the premises for any unlawful, commercial, or hazardous purpose.
6. MAINTENANCE AND OUTGOINGS
Electricity, piped gas, internet, and day-to-day consumables shall be paid by the Licensee. Property tax and society outgoings, unless specifically agreed otherwise, shall be borne by the Licensor.
7. SOCIETY RULES
The Licensee shall follow all society rules, guest regulations, parking instructions, and security requirements applicable to the building.
8. ALTERATIONS
The Licensee shall not make structural changes, drilling, permanent fixtures, or modifications without prior written consent of the Licensor.
9. INSPECTION
The Licensor may inspect the premises on prior reasonable notice for maintenance, repair, or verification purposes.
10. TERMINATION
Either party may terminate this Agreement by giving [30] days' written notice to the other party. If the Licensee defaults in payment or misuses the premises, the Licensor may terminate the license in accordance with law.
11. HANDOVER
Upon expiry or termination, the Licensee shall hand over vacant and peaceful possession of the premises along with keys, access cards, and fixtures in reasonable condition subject to normal wear and tear.
12. REGISTRATION AND STAMP DUTY
The parties agree to complete registration and stamp duty formalities as required under applicable law in Maharashtra. Expenses shall be shared in the following manner: [Insert Sharing Terms].
13. POLICE / KYC FORMALITIES
The Licensee shall provide identity proof, photographs, and other KYC records required for society, registration, or police verification.
14. DISPUTE CLAUSE
Any dispute arising out of this Agreement shall be subject to the jurisdiction of competent courts at Mumbai.
